Terms & Conditions

​

Mindful-tutoring assumes that you are aware of these conditions if you register with `mindful-tutoring‘ for my services, like English lessons and practicing mindfulness techniques.

General 

These General Terms and Conditions apply to all agreements between ‘Kerstin Waldstein – mindful-tutoring’ and ‘Participant’. Participant is defined as any natural or legal person who actually registers for and/or participates in a course.

Registration

The registration is confirmed when the Participant has received a digital confirmation of registration from mindful-tutoring. Mindful-tutoring has the right to refuse registrations, without giving any reason. The Participant the right to dissolve the agreement without giving any reason within 14 working days after receiving the digital confirmation.

Cancellation

Cancellation must be sent digitally by the Participant to kerstin.waldstein@gmx.de or www.mindful-tutoring.com. Cancellation is effective on the date the digital cancellation is received. In case of cancellation after the invoice has been sent to the Participant, the Participant will be charged a € 20 administration fee by mindful-tutoring.com. Up to 14 days before the start of a course or a workshop 50% will be charged and in case of cancellation from the 7th day until the date of commencement 100% of the total amount will be charged to the Participant. If the Participant does not attend the course or the workshop he signed up for and has not cancelled, the total amount will be charged. In case of payment by a third party, the Participant remains responsible for paying the full amount. If the Participant himself can find a replacement that meets the conditions, only the administration costs will be charged. If the Participant is absent for one or more days, no refund will be given.

If the reason for absence is due to compelling private circumstances, the Participant in consultation with mindful-tutoring may be able to join the following course or workshop to catch up on the missed day. No refund will be given after the start of the course or the workshop.

Payment

Payment must be made within the payment term (indicated on the invoice) and before the commencement of the course or the workshop by bank transfer. This also forms the guarantee for participation. In the case of late payment, the place of the Participant may be given to someone else on the waiting list, but does not release the Participant from the payment obligation. An exception to the payment term may be possible if there is a payment arrangement (payment in instalments is possible in consultation).

 

Cancellations and Changes made by ‘mindful-tutoring‘

All courses and workshops are held subject to sufficient registrations. Mindful-tutoring reserves the right to cancel a course or to postpone it to a later date in urgent reasons. ‘Mindful-tutoring‘ may unilaterally change these terms and conditions for reasons. ‘Mindful-tutoring‘ must publish these changes on the website immediately.

Entrance requirements and course completion

There are no prior education requirements for the courses and workshops.

Safety and well-being

‘Mindful-tutoring’is experienced in tutoring individuals and groups and I put the safety and integrity of the Participant/Client first. The Participant is at all times responsible for his / her own well-being.

I conform to the following code of ethics:

  • Show respect for the dignity and integrity of the Participant.

  • Will keep any personal matters strictly confidential.

  • Organize the course or the workshop with lots of care and create a positive learning environment in which the Participant/Client are respected.

  • Always strive to maintain and develop the autonomy of the Participant.

Privacy

‘Mindful-tutoring‘ guarantees that anything shared by the Participant in confidence during a course or a workshop, is treated with the greatest respect and trust.

Complaints procedure 

If there is a complaint about a course or a workshop, the Participant can report this complaint in writing to kerstin.waldstein@gmx.de or to www.mindful-tutoring.com. ‘Mindful-tutoring‘ will send a confirmation of receipt within 2 working days of receiving the complaint and will deal with this complaint as soon as possible, within 4 weeks. Should the handling of the complaint take longer than expected, then ‘mindful-tutoring‘ will specify a new term within which the Participant can expect completion. The complaint will always be treated confidentially. ‘Mindful-tutoring‘ will make every effort to find a solution to the full satisfaction of all parties, but should this not be possible despite all efforts, ‘Mindful-tutoring‘ will appoint a third, independent party (an appropriate lawyer will be appointed via Stichting Rechtswinkel.nl). The statement of this party is binding for ‘Mindful-tutoring‘ and the Participant and will be dealt with promptly. The mediation costs incurred for engaging a third party will be borne by the party who has been unsuccessful after the judgment. The file that has been created to register the complaint and in which the handling is described, is kept for 2 years.

Terms of correspondence

Questions of an administrative nature or with regard to a course or a workshop will be answered within 5 working days. For questions that require a longer processing time, the Participant/Client will receive a confirmation of receipt within 5 days with an indication of when the Participant can expect a detailed answer.

Ownership

The copyright on the course material and training materials and the other materials provided in the course or the workshop are held by ‘mindful-tutoring‘.

Without the explicit written consent of ‘mindful-tutoring‘no data from and / or parts and / or excerpts from the provided course materials may be published or multiplied in any way.
